Si une telle offre est apparue en Am\u00e9rique du nord d\u00e8s la fin des ann\u00e9es 90, ce n\u2019est que r\u00e9cemment que des startups de la legaltech mais aussi des professions r\u00e9glement\u00e9es ou encore des acteurs traditionnels de la justice alternative, ont entrepris de d\u00e9velopper en France des services d\u00e9mat\u00e9rialis\u00e9s de conciliation, de m\u00e9diation et d\u2019arbitrage, en offrant des degr\u00e9s variables de digitalisation du processus de r\u00e8glement des diff\u00e9rends pouvant aller de la simple saisine en ligne \u00e0 l\u2019utilisation de l\u2019intelligence artificielle. Ces prestations en ligne soul\u00e8vent de multiples questionnements qui pour certaines sont li\u00e9s \u00e0 la nature des services offerts. Quels sont les processus de r\u00e8glement du diff\u00e9rend&nbsp;mis en \u0153uvre par ces services e-RED ? Comment cette offre est-elle re\u00e7ue par les justiciables&nbsp;? Quelles perspectives de d\u00e9veloppement l\u2019intelligence artificielle offre-t-elle \u00e0 cette justice alternative en ligne ? D\u2019autres, plus fondamentaux, sont li\u00e9s aux bouleversements induits par ces offres dans la mani\u00e8re de penser et de faire justice. Les services de r\u00e8glement extrajudiciaire des diff\u00e9rends participent-ils \u00e0 l\u2019offre de justice ? Peuvent-ils \u00eatre envisag\u00e9es comme les vecteurs d\u2019une justice plus accessible ? Permettent-ils de pr\u00e9server l\u2019effectivit\u00e9 des droits des justiciables ? Les difficult\u00e9s rencontr\u00e9es par les services e-RED \u00e9mergents pour p\u00e9renniser leurs offres et convaincre les justiciables que les prestations qu\u2019ils proposent participent des proc\u00e9d\u00e9s de justice am\u00e8nent \u00e0 questionner les orientations de la France qui encourage les offres priv\u00e9es de e-justice alternative sans penser leur articulation avec le service public de la justice pourtant lui aussi engag\u00e9 dans un processus de digitalisation. Les mod\u00e8les de d\u00e9veloppement d\u2019une justice en ligne retenus par d\u2019autres pays am\u00e8nent \u00e0 envisager une autre voie.<\/p>\n\n\n\n<details class=\"wp-block-details is-layout-flow wp-block-details-is-layout-flow\"><summary>English version below \/ R\u00e9sum\u00e9 en anglais <\/summary>\n<p class=\"wp-block-paragraph\">The convergence of two movements\u2014the emergence of digital justice on the one hand, and the development of alternative dispute resolution promoted by French and European public authorities on the other\u2014has created a favorable context for the deployment in France of online extrajudicial dispute resolution services (e-ADR services). While such offerings appeared in North America as early as the late 1990s, it is only recently that legaltech startups, as well as regulated professions and traditional actors in alternative justice, have begun to develop dematerialized conciliation, mediation, and arbitration services in France. These services provide varying degrees of digitalization in the dispute resolution process, ranging from simple online referral to the use of artificial intelligence.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These online services raise a number of questions, some of which relate to the nature of the services offered. What dispute resolution processes are implemented by these e-ADR services? How are they perceived by users? What development prospects does artificial intelligence offer for this form of online alternative justice? Other, more fundamental questions concern the transformations these services bring about in how justice is conceived and delivered. Do extrajudicial dispute resolution services form part of the broader justice system? Can they be seen as vehicles for more accessible justice? Do they ensure the effective protection of users\u2019 rights?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The difficulties encountered by emerging e-ADR services in sustaining their business models and in convincing users that the services they provide genuinely constitute forms of justice call into question the policy direction adopted in France. This approach encourages private e-ADR offerings without sufficiently considering their articulation with the public justice system, which is itself undergoing a process of digital transformation.
